The Delhi High Court has decreed a trademark infringement suit filed by Singh and Singh Law Firm LLP against Singh and Singh Chartered Accountants after recording a settlement under which the CA firm agreed to change its name to “SINGH M & CO” and transfer the domain name singhandsingh.in to the plaintiffs.
Justice Jyoti Singh, in an order dated March 25, 2026, recorded the settlement between the parties and directed that the defendants complete the transfer of the domain name by May 6, 2026.
The court noted the terms of settlement that the CA firm must completely cease all use of the impugned marks across all platforms by June 7, 2026, and must actively cooperate with the law firm to remove infringing content from third-party social media pages and intermediaries.
Singh and Singh Law Firm had contended that they were the absolute owners of the registered mark “Singh & Singh” and sought to protect it from unauthorized use by a firm of chartered accountants.
The law firm argued for a permanent injunction, alleging that the defendants' trading style was deceptively similar to their established legal brand.
The court observed that an interim injunction had already been issued on February 26, 2026, which restrained the defendants from using the impugned marks and directed the deletion of infringing content.
Through the recorded settlement, the CA firm acknowledged the plaintiffs' “unconditional, exclusive, and absolute ownership” of the mark and name “Singh & Singh."
The settlement records that the defendants undertook to remain bound by the injunction order, while the plaintiffs agreed not to press for damages or costs. The terms further provide that any breach of the settlement would entitle the parties to pursue remedies in law, including contempt of court.
The court noted that the defendants had proposed alternative names for their firm and had already changed the name to “SINGH M & CO”.
The bench directed the Registry to draw up the decree sheet and cancelled the hearing date fixed for April 29, 2026.
