Delhi High Court Temporarily Restrains 'Singh and Singh Chartered Accountants' In Trademark Suit Filed By Law Firm

The Delhi High Court on Thursday granted an ad-interim injunction restraining a chartered accountancy firm from using the name “Singh and Singh Chartered Accountants” in a trademark infringement suit filed by Singh and Singh Law Firm LLP.
The order was passed by Justice Jyoti Singh after hearing the submissions of the law firm at the ad-interim stage.
During the hearing, the court sought clarification on the nature of the defendants' business, asking, “These are what, chartered accountants?” Counsel for the plaintiffs confirmed that the defendants were operating as “Singh and Singh Chartered Accountants.”
Referring to the defendants' earlier reply, the law firms' counsel submitted that the CA firm had stated it was “engaged in rendering services like GST compliance, taxing advisory, audit, etc.” and did not render “legal representation, advocacy or law firm representation.” The Court observed, “So they are not into legal advocacy.”
The plaintiffs, however, disputed the distinction and argued that taxation practice is inherently legal in nature. “Taxation practice is as legal as it comes,” counsel submitted. It was further contended that the defendants' adoption of the name was subsequent to that of the plaintiffs and that mere long use would make no difference in view of the plaintiffs' prior adoption and registered trademark.
Counsel also stated that the plaintiffs became aware of the defendants' use of the name only in February 2026, and therefore there was no question of acquiescence. Emphasising that the plaintiffs hold a registered mark, it was argued that the continued use of the impugned name amounted to infringement.
After hearing the plaintiffs' submissions, the Court stated, “Alright, injunction granted,” and restrained the CA firm at the ad-interim stage.
The court granted the plaintiffs two weeks to comply with Order XXXIX Rule 3 of the Code of Civil Procedure, 1908, which requires service of the injunction papers on the defendants.
The matter is listed before the joint registrar on March 23 and before the court on April 29.
