Delhi High Court Issues Notice To Trade Marks Registrar Over Delay In Deciding MakeMyTrip's Well-Known Mark Plea

The petition was filed after the application remained undecided for over six years.

Justice Vikas Mahajan passing the order on September 21, recorded: “Ms. Nidhi Raman, CGSC who is present in Court has been asked to accept notice. Let Ms. Raman seek instructions.”

MakeMyTrip had filed its Well-Known Mark Application in January 2020.

The application was accepted for publication and appeared in the Trade Marks Journal in June 2023, inviting oppositions.

The only opposition, filed by rival travel platform Easy Trip Planners, was withdrawn in April 2025 following a settlement between the two companies.

MakeMyTrip's counsel confined the petition to seeking a time-bound direction for disposal of the application, rather than asking the court to declare the mark well-known itself.

He argued that with the sole opposition withdrawn, the Registrar ought to have taken a final decision, and that the application had remained pending for six years without any justification.

The court issued notice to the Registrar of Trade Marks, with the counter affidavit to be filed within three weeks and any rejoinder before the next hearing.

The matter is next listed for November 3, 2026.
