NCLT Mumbai Suspends One Court Due To Vacancies, Redistributes Pending Cases

The National Company Law Tribunal (NCLT) has suspended the functioning of Court No. VI at its Mumbai Bench from October 13 until further orders, citing vacancies in Member posts. Pending cases will be redistributed among the bench's five other courts.
In an order dated October 9, issued with the approval of the NCLT President, the tribunal directed the transfer of all cases pending before Court No. VI to Courts I to V.
The redistribution covers insolvency proceedings under Sections 7, 9, 10 and 95 of the Insolvency and Bankruptcy Code (IBC), 2016. Under the allocation for Section 7 cases, matters numbered 1–39 will go to Court I, those numbered 40–78 to Court II, 79–117 to Court III, 118–157 to Court IV and 158–196 to Court V. The order specifies similar allocations for proceedings under the other sections.
Court officers have been directed to transfer the case records and list the matters for their next hearings in accordance with the last order sheet in each case. The Joint Registrar of the Mumbai Bench must also ensure that the physical records are transferred and the changes are reflected in the Case Information System (CIS).
A compliance report must be submitted to the NCLT Principal Bench in New Delhi by October 14.
The development comes amid judicial scrutiny of delays and infrastructure gaps at the tribunal. On April 29, the Supreme Court took suo motu cognisance of delays in NCLT proceedings, observing that time-bound resolution under the IBC had become “impossible to achieve”.
On September 21, a Supreme Court bench headed by Chief Justice of India Surya Kant directed the Centre to submit a status report on basic amenities at the NCLT Principal Bench and its regional Benches.
The NCLT has six courts at its Mumbai Bench. Its official website lists nine Members against the bench, while the tribunal has 48 Members nationally against a sanctioned strength of 62. The national strength comprises 26 Judicial Members and 22 Technical Members.
