  • Flipkart Faces Fresh Insolvency Plea Before NCLT Bengaluru Over ₹1.69 Crore Marketing Services Dues

The National Company Law Tribunal at Bengaluru has issued notice to Flipkart Internet Private Limited on a plea filed by Applabs Media Private Limited seeking initiation of insolvency proceedings over an alleged operational debt of ₹1.69 crore.

A coram of Judicial Member Mahendra Khandelwal and Technical Member Radhakrishna Sreepada passed the order.

According to the operational creditor, the debt arises from three invoices amounting to ₹1.69 crores raised under a Marketing Agreement dated December 5, 2019. Under the agreement, Applabs Media was engaged to provide cost-per-transaction campaign services for events conducted through mobile applications and other digital platforms.

The operational creditor submitted that invoices were raised in accordance with the terms of the agreement and were payable within 45 days. However, despite rendering services and raising invoices, the amounts allegedly remain unpaid.

It was further contended that a demand notice under Section 8 of the IBC was issued to Flipkart and a reply was received. Applabs Media argued that there was no prior communication evidencing any pre-existing dispute regarding the invoices. Reliance was placed on an email dated May 8, 2023, and a reconciliation statement shared on May 15, 2023, which, according to the operational creditor, reflected a clear admission of liability by Flipkart.

Recording the submissions, the Tribunal observed:

"Let notice be issued to the operational creditor. For filing their response and appearance, notice be issued by all means and proof of service be filed. List the matter on July 14, 2026."

The matter is scheduled for further hearing on July 14, 2026.

Notably, another insolvency application was recently filed against Flipkart before the NCLT Bengaluru. In a separate petition filed by Netambit Value First Services Private Limited seeking initiation of corporate insolvency resolution proceedings against Flipkart, the Tribunal had also issued notice.
