    The Madras High Court has granted a temporary injunction against three Haryana-based pharmaceutical companies over their use of the mark "ORG-9" after a prima facie finding that it infringes the registered trademark "ARG-9" owned by Chennai-based Nouveau Medicament Private Limited.

    Justice K. Kumaresh Babu passed the ad-interim order on July 27.

    Nouveau Medicament Private Limited, a Chennai-based pharmaceutical company, submitted that it holds registration for the trademark "ARG-9".

    The respondents, Orange Biotech Private Limited, Ritual Drugs Private Limited, and Akshar Molecules Inc, were alleged to have been involved in manufacturing a similar pharmaceutical product under the mark "ORG-9".

    Nouveau Medicament alleged that the respondents' mark "ORG-9" is deceptively similar to its own registered mark "ARG-9".

    The Court noted that both parties are pharmaceutical manufacturers and that the marks in question are both alpha-numeric, differing only in the arrangement of letters around the number 9.

    The bench granted the interim injunction as prayed for in all three applications, restraining the respondents and everyone acting on their behalf from manufacturing, selling, distributing, or otherwise dealing in any goods or services under the "ORG-9" mark, or any mark deceptively similar to "ARG-9," till further orders.

    Notice was ordered to be issued to the respondents, returnable in four weeks, with the matter listed for further hearing after that period.
