Delhi High Court Temporarily Restrains Sale Of Counterfeits With Sun Pharma's 'Photostable,' 'Bello' Marks

The Delhi High Court on 10 August granted an ad-interim injunction restraining several entities from selling counterfeit dermatological and skincare products bearing Sun Pharma Laboratories Ltd's registered trademarks 'PHOTOSTABLE' and 'BELLO'.

Justice A. J. Bhambhani passed the order in a commercial suit filed by Sun Pharma Laboratories Ltd against Wear and Glow and other defendants, alleging trademark infringement. The Bench observed:

“the plaintiffs have succeeded in making-out a prima-facie case in its favour” and held that “the balance of convenience also lies in favour of the plaintiffs and against the defendants.”

Sun Pharma submitted that it was the registered proprietor of the trademarks 'BELLO' and 'PHOTOSTABLE'. It submitted that 'PHOTOSTABLE' covers two distinct product sub-ranges, 'BELLO PHOTOSTABLE' and 'PHOTOSTABLE GOLD', both marketed in India in relation to dermatological and skincare products.

The company alleged that Defendants No. 1 to 13 were selling identical counterfeit products bearing these trademarks. It sought an ad-interim injunction restraining the defendants from using 'PHOTOSTABLE', 'BELLO', or any mark deceptively similar to these marks or to its house mark 'SUN'. It also sought restraint against reproduction of its original artistic works, trade dress, packaging and labels.

The Court held that “irreparable loss and injury would be caused to the plaintiffs if the interim injunction as prayed-for is not granted” and restrained the defendants from using the marks 'PHOTOSTABLE', 'BELLO' and the plaintiffs' house marks 'SUN'/'SUN PHARMA', and from reproducing the plaintiffs' original artistic works, trade dress or packaging, until the next date of hearing.

The matter is listed before the Joint Registrar on 17 November 2026 for completion of pleadings.
