The Delhi High Court has temporarily restrained the manufacturer and sellers of electrical wires sold under the brand RK Cables from using packaging that allegedly imitates V-Guard Industries Limited's black-and-yellow trade dress.
The court has also directed online marketplaces IndiaMART and TradeIndia to remove specified listings of the products.
Justice Vikas Mahajan passed the order on October 13, 2026.
V-Guard sued R.K. Industries, which makes the RK Cables wires, along with four sellers and the two marketplaces. It says the packaging of RK Cables is nearly identical to the trade dress it has used for its V-Guard wires and cables since 2017, which is protected by trademark and copyright registrations.
V-Guard learned of the product in the first week of June 2026, but could not trace the manufacturer, as the address on the box was incomplete. It therefore named it as “Ashok Kumar/John Doe”. A sample purchase made on June 25, 2026 showed that one of the sellers was formerly a V-Guard channel partner.
The Court found that “a prima facie case of infringement and passing off is made out in favour of the plaintiff and balance of convenience is also in its favour,” adding that irreparable harm would follow if no injunction were granted.
Until the next hearing, RK Cables and the four sellers, along with their licensees, distributors and dealers, are restrained from manufacturing, selling, advertising or otherwise dealing in electrical goods, including wires, under the impugned packaging.
The restraint also covers any yellow and black combination or other packaging that is a colourable imitation or substantial reproduction of V-Guard's.
IndiaMart and TradeIndia must take down the listed product links within one week of V-Guard communicating the order, and file compliance affidavits within two weeks after that.
The matter will be heard next on February 4, 2027.
