Delhi High Court Temporarily Restrains One-Person Company From Using 'Media Monk' Name

The Delhi High Court has temporarily barred a one-person company from using the name “Media Monk” after finding it deceptively similar to the global digital brand MediaMonks and likely to mislead consumers.
Justice Tushar Rao Gedela granted an ex parte ad interim injunction against Systemry Global Tech (OPC) Pvt. Ltd. The court restrained the company from using the marks “Media Monk”, “MediaMonk”, the domain name mediamonk.ai, or any other mark or domain that is deceptively similar to “MediaMonks”.
The suit was filed by Mediamonks Multimedia Holding B.V., a Netherlands based digital services company. It has been operating since 2001 and provides digital services in advertising, marketing, media, technology and software.
It adopted the trademark “MediaMonks” in 2001. It began business operations in India in 2019. The company reported India revenues of approximately Rs 117.8 crore in 2022.
Before the court, Mediamonks said that Systemry was incorporated in 2024 as a one-person company of Shashibala Agarwal. It alleged that Systemry was offering allied and cognate digital services under the name “Media Monk”. These included technology driven tools for marketing, sales, content creation, and customer support.
The court compared the rival marks and domain names. It found them to be deceptively similar. The only difference, the court noted, was the deletion of the letter “s” from “MediaMonks”.
Recording a prima facie finding, Justice Gedela said the deceptive similarity of the trademark and the domain name was likely to confuse an unwary consumer of average intelligence with imperfect recollection.
"The deceptive similarity in the trademark and the domain name is most likely to confuse and deceive an unwary consumer of average intelligence with imperfect recollection from making out fine the distinction between the tradename of the plaintiff from that of the defendant", the bench said.
Holding that the balance of convenience lay in favour of Mediamonks, the court said irreparable harm would be caused if interim relief was denied. It restrained Systemry, its directors, shareholders, employees, and agents from using the impugned marks or any deceptively similar mark.
The court has issued notice to the OPC. The matter is listed for further hearing on July 16, 2026.
