    The Delhi High Court on 23 July restrained Saroj Arora and associated entities (including Asia Paints and Ashind Industries) from using the mark 'Asia Paints' in a trademark infringement and passing off suit filed by Asian Paints Limited.

    A Bench of Justice Anup Jairam Bhambhani found that Asian Paints had established a prima facie case for interim protection. He observed:

    “It would appear that irreparable loss and injury would be caused to the plaintiff if the interim injunction as prayed-for is not granted.”

    Asian Paints claimed ownership of the well-known trademark and trade name 'ASIAN PAINTS', which it has registered across various classes. It submitted that defendants No. 1 to 4 operate a firm named Asia Paints, while defendants No. 3 and 4 also serve as directors of Ashind Industries Private Limited.

    The company also alleged that the defendants use the mark 'ASIA PAINTS' for wall paints, distemper, thinner and other allied products, which fall within the same category of goods covered by its trademark registrations.

    It sought directions to remove the defendants' social media pages and third-party e-commerce listings referring to the impugned marks, suspend the domain name 'asiapaints.in', and direct internet service providers to block access to the website.

    The Bench held that Asian Paints had made out a prima facie case in its favour after a preliminary assessment of the matter and that the balance of convenience favoured granting interim relief.

    Accordingly, the High Court restrained defendants No. 1 to 5 and persons acting on their behalf from manufacturing, selling, advertising or using the trade name 'ASIA PAINTS', the accompanying logos, or any mark deceptively similar to Asian Paints' registered 'ASIAN PAINTS' trademarks until the next date of hearing. It issued notice on the interim application, and defendants No. 7 and 8 accepted notice through counsel.

    The matter is listed for completion of pleadings before the Joint Registrar on 29 October 2026.
