The Delhi High Court has recently extended an earlier ex-parte ad-interim injunction in favour of Jaquar And Company Private Limited after impleading 22 additional entities, restraining 19 of them from using the trademark “JAQUAR”.
The Court restrained them from using the mark and directed banks to freeze accounts opened in a deceptively similar name.
The relief was originally granted on November 3, 2025. At that stage, the Court recorded that Jaquar And Company Private Limited, the Indian bathroom fittings and sanitaryware manufacturer, is the registered proprietor of the well-known trademark “JAQUAR”. The mark was declared a well-known trademark on February 19, 2024.
In the November order, the Court noted that certain defendants had registered and operated the domain names “jaquarfranchise.com” and “jaquardealership.com”. The Court recorded that these defendants were offering fake dealership and franchise opportunities under the “JAQUAR” name.
The Court observed that the defendants' acts demonstrated “mala fide and deliberate infringement”. It further held that the conduct was intended to “misuse the Plaintiff's goodwill, mislead the public, and unlawfully profit from the Plaintiff's reputation.” An ex-parte ad-interim injunction was consequently granted against Defendants No. 1 to 5.
Subsequently, on February 10, 2026, Justice Jyoti Singh allowed the impleadment of 22 other new parties. The Court extended similar injunctive relief against the 19 newly impleaded parties.
They were restrained, until the next date of hearing, from using the mark/name/logo “JAQUAR” or any deceptively similar variation. The restraint applies to use as part of a domain name, trademark, service mark, or trading style or corporate name. It covers use in relation to any goods or services, whether on the internet or otherwise.
The concerned domain name registrar and the hosting entity were directed to lock and suspend the domain names “jaquarfranchise.in” and “jaquarbusiness.com”. They were also directed to disclose the names, contact details and payment information of the concerned parties in a password-protected document or sealed cover.
In addition, Indian Bank, Punjab National Bank and IDBI Bank Ltd. were directed to suspend, freeze and/or disable specific bank accounts opened in the name “Jaguar And Company Private Limited”.
The banks were further directed to furnish complete KYC details and statements of transactions in a password-protected document or sealed cover.
Jaquar was granted liberty to approach the Registrar with supporting evidence. This liberty enables it to seek extension of the directions to other third parties operating rogue domain names or websites violating its statutory rights.
The defendants have been granted four weeks to file replies. The matter is listed before the Joint Registrar on April 7, 2026. It is returnable before the Court on April 13, 2026.
