Delhi High Court Restrains Antex Pharma From Using Similar Marks To Nava Healthcare's HAIRFUL, UDIVIN

The Delhi High Court on 24 July restrained Antex Pharma Pvt Ltd from manufacturing or selling pharmaceutical products under marks and trade dress allegedly similar to Nava Healthcare's registered brands HAIRFUL and UDIVIN, after finding a prima facie case of trademark infringement and passing off.

Justice Jyoti Singh passed the order, holding that “prima facie, Defendants are infringing the registered trademarks of the Plaintiff.”

Nava Healthcare, incorporated in 2006, informed the Court that it markets around 185 pharmaceutical products, including those sold under the trademarks HAIRFUL, registered since 2014 for a hair supplement label, and UDIVIN, used since 2012 with a green-and-white trade dress featuring a distinctive “three arrows” device.

The company also claimed rights over the PANTOPRAZ I.V. injection trade dress, which has been in use since 2008. The three arrows artistic work is separately registered under copyright in Nava Healthcare's favour.

It alleged that in December 2024, it discovered that Antex Pharma, along with a third party, was using deceptively similar marks, devices and trade dress for products sold under the names CIZINE, IBUFLAM-P and RUSSOFF-DX.

The Bench found that the competing products operated through similar trade channels and targeted the same consumer base, creating a likelihood of confusion. It held that Nava Healthcare had established a prima facie case of infringement and passing off.

Accordingly, the High Court granted an ex-parte ad interim injunction restraining Antex Pharma from manufacturing, selling, offering for sale, advertising or promoting products under the FULLHAIR label, the UDIS mark and trade dress, or any other mark, trade dress or packaging deceptively similar to Nava Healthcare's HAIRFUL, UDIVIN and PANTOPRAZ I.V. marks and trade dress. It also restrained the use of the copyrighted three-arrows artistic work in any manner.

The matter is listed to be heard again on 3 December 2026.
