Delhi High Court Restrains Rogue Websites From Using Well-Known GATI Mark For Packers, Movers Services

The Delhi High Court has restrained 36 operators of rogue websites and an unidentified person from offering packing, shifting, and relocation services under marks incorporating the well-known “GATI” or deceptively similar variants.
The court also directed domain registrars, including GoDaddy, to lock and suspend the domains listed in the order within 36 hours of receiving a copy of the order.
Justice Jyoti Singh was hearing an application filed by Allcargo Logistics Limited seeking an ex-parte ad-interim injunction against entities allegedly using deceptively similar variants of its “GATI” trademark through rogue websites.
Allcargo told the court that its predecessors adopted the GATI mark in 1989 and that it has been used continuously since then. The order records that the mark has been used openly, continuously, and extensively and is associated with Allcargo and its predecessors.
The company traced the mark's history to Gati Limited, which entered into a joint venture with Japanese logistics company Kintetsu World Express in 2012. Allcargo acquired a stake in Gati Limited in 2020 and became its promoter and largest shareholder.
It purchased Kintetsu's remaining 30% stake in 2023, after which Gati Limited was renamed Allcargo Gati Limited. In 2025, Allcargo Gati Limited and its sister concern were amalgamated with Allcargo Logistics pursuant to an order of the National Company Law Tribunal.
The GATI mark is included in the Trade Marks Registry's list of well-known marks at Serial No. 36 of Journal No. 2144, published on February 19, 2024.
Allcargo's case was that 36 website operators were marketing, displaying, advertising and providing packing, shifting and relocation services under marks incorporating GATI. The order records several such variants, including “GATI Packers & Movers”, “GATI Cargo Movers” and “GATI Express”.
The company also alleged that the operators were using several rogue websites, with GATI incorporated into their domain names. Some had allegedly replicated the layout and look and feel of Allcargo's website to encash on its goodwill and reputation.
The court found that Allcargo had made out a prima facie case for an ex-parte ad-interim injunction. It also found that the balance of convenience favoured the company and that it was likely to suffer irreparable harm if interim protection was not granted.
Before the quote, the court noted that GATI had been used since 1989 and was entitled to a high degree of protection as a well-known mark.
The court observed, “Defendants have incorporated and subsumed the mark GATI in entirety in the impugned marks, which prima facie reflects dishonest intention to take advantage of Plaintiff's goodwill.”
The court found that the rival marks and services were similar and that there was “every likelihood of confusion in members of public and trade”. It further held that, prima facie, the website operators were infringing Allcargo's registered GATI marks and passing off their services as those of the company.
The court also took note of the anonymity surrounding the websites. It observed that they did not disclose verifiable contact particulars and that the registrants' WHOIS details were masked, leaving their actual identities undisclosed.
“Sale through rogue websites with actual identities of counterfeiters and infringers being masked is a menace, which is ever increasing and needs to be curbed,” the court observed.
The interim order restrains the 36 website operators, the unidentified party and others acting on their behalf from marketing, advertising or offering the impugned services using the specified GATI marks or any other deceptively similar variant, amounting to trademark infringement or passing off.
The court separately directed the domain registrars and other intermediaries responsible for the listed domains to lock and suspend the domains registered with them and listed in the plea within 36 hours of receiving a copy of the order
The matter will next be heard on December 10, 2026.
