Delhi HC Restrains Use Of MakeMyIndiaTrip Mark, Says Adding 'India' Does Not Distinguish It From MakeMyTrip

The Delhi High Court has temporarily restrained MakeMyIndiaTrip from using the marks "MakeMyIndiaTrip" and its logo, holding that the addition of the word "India" was insufficient to distinguish the impugned marks from MakeMyTrip's registered trademark.
Justice Jyoti Singh passed the order on May 29 in a trademark suit filed by online travel platform MakeMyTrip (India) Private Limited. The Court found a prima facie case of infringement and observed that the adoption of the impugned marks appeared to be in bad faith.
The defendant's website and social media presence were also covered by the restraint order.
MakeMyTrip discovered the infringing marks in the first week of March 2026 during a routine internet check. The defendant's website, www.makemyindiatrip.com, was found to be offering international and domestic travel packages, group tours, car rentals, and travel booking services in a manner closely modeled on MakeMyTrip's format.
The defendant was also found to be actively advertising on Facebook, Instagram, and YouTube under the impugned marks.
The company argued that the marks 'MakeMyIndiaTrip' and its logo were visually, structurally, and conceptually identical to its registered marks. It submitted that the insertion of 'India' into an otherwise identical coined mark could not serve as a distinguishing feature, particularly when both parties were operating in identical services targeting a common customer base.
The court agreed. "Confusion amongst members of public and potential customers cannot be ruled out looking at the expanse of use of Plaintiff's trademark continuously, uninterruptedly and openly," Justice Singh observed.
The court further held that "any person who would look at the rival marks is bound to have an initial interest confusion, point of sale confusion as also post-sale confusion."
It found that continued use would dilute and erode the goodwill and reputation MakeMyTrip had built over more than two decades.
MakeMyTrip, incorporated in 2000 by Deep Kalra, holds multiple registered trademarks across several classes in India and in countries including Australia, Canada, the UAE, and Singapore.
The word mark 'MakeMyTrip' has been in continuous use since 2000. The company describes it as a coined and invented mark, and claims to be the first to use the structural device of linking words through 'MY' to form a single composite brand identity.
The defendant is restrained from using the trade name MakeMyIndiaTrip, its logo, the domain www.makemyindiatrip.com, and any email ID subsuming MakeMyTrip's registered mark.
The matter is next listed before the court on October 6, 2026.
