The Delhi High Court on 16 October directed Bikanervala Foods Private Limited to remove all products bearing the “ANANDAM” mark from its website within 24 hours in a trademark dispute with Anandam Sweets Private Limited.
Justice Vikas Mahajan also directed Bikanervala's authorised representative who gave the undertaking to remain physically present at the next hearing. The Bench observed:
“Having regard to the rival contentions, this Court is of the view that it is not the case of the defendant that the product with infringing mark ANANDAM is no more being listed as their product on their official website.”
Anandam Sweets alleged that Bikanervala had breached its undertaking dated 17 October 2025 to discontinue the use of “ANANDAM” on gift hamper packaging.
Under the undertaking, Bikanervala had agreed to stop procuring packaging bearing the mark from 17 October 2025. It stated that it held around 5,800 boxes, which it would exhaust by 15 November 2025 or destroy if any remained. It had also undertaken not to sell gift hampers under the mark after that date or sell the remaining stock to anyone in Uttarakhand.
Senior Advocate Satvik Verma, appearing for Anandam Sweets, submitted that the company had recently discovered that Bikanervala continued to use the old packaging. During the hearing, he accessed Bikanervala's website and showed the Court that the “ANANDAM” gift pack remained listed.
Bikanervala's counsel did not dispute the listing but submitted that the product was displayed as out of stock.
The Bench rejected this explanation and directed Bikanervala to remove all products bearing the mark from its website within 24 hours.
It issued notice on the contempt application, which Bikanervala's counsel accepted. It directed Bikanervala to file its reply within one week, followed by a rejoinder before the next hearing. The authorised representative who gave the 2025 undertaking must remain physically present on that date.
The matter is listed for 30 October 2026 without recording a finding of contempt.
