Bombay High Court Orders Takedown Of Video Claiming Bisleri Bottles Filtered Drain, Toilet Water

  • Bombay High Court Orders Takedown Of Video Claiming Bisleri Bottles Filtered Drain, Toilet Water

The Bombay High Court has granted Bisleri International interim protection against social media posts alleging that its packaged drinking water is made from filtered drain and toilet water.

Calling the video “prima facie disparaging and denigrating” and “plainly malicious”, the Court directed its removal and restrained further circulation of the allegations.

Justice Arif S. Doctor passed the order on October 30 in a suit filed by Bisleri against Meta Platforms and several other defendants, including individuals accused of uploading and circulating the video.

Bisleri told the Court that the video falsely depicted a manufacturing facility unconnected with the company and claimed that its bottled water was sourced from drains and toilet wastewater.

The company submitted that it holds a valid FSSAI central licence until May 2028 and that its manufacturing facilities are regularly audited by FSSAI-accredited agencies. It also said an enquiry into the premises shown in the video established that they did not belong to Bisleri or any of its licensees, franchisees or co-packers.

Bisleri said its marketing team discovered the video on October 27 and that it had since been widely circulated on Instagram, Facebook, LinkedIn and X, among other platforms.

After viewing the video, the Court observed that it contained categorical allegations suggesting that Bisleri was selling contaminated and unsafe drinking water.

“The manner in which the allegations are presented creates an impression that the Plaintiff is, infact, not selling safe packaged drinking water but is bottling and selling non-potable water to unsuspecting consumers,” it said.

The Court held that the widespread circulation of the video justified Bisleri's apprehension that the allegations could be further amplified, causing irreversible damage to its goodwill and reputation. It found that giving the defendants prior notice would defeat the purpose of granting urgent relief.

Accordingly, the Court directed the concerned defendants to remove or disable access to the impugned posts, including identified reposts and copies.

It also restrained them from publishing or circulating the video or repeating allegations that Bisleri manufactures or bottles packaged drinking water using contaminated water or wastewater.

The Court further granted a dynamic injunction covering substantially identical or similar versions of the video, including those circulated through newly created accounts or URLs, upon Bisleri furnishing their particulars to the defendants without having to approach the Court again.

The matter will be heard next on November 26, 2026.
