Bombay High Court Directs Trader To Deposit ₹1.32 Crore For Breaching NOVA Trademark Injunction

The Bombay High Court on 1 September directed a trader who had appealed against an Rs. 82.42 lakh costs order for violating a trademark injunction to deposit an additional Rs. 50 lakh, taking the total amount to Rs. 1.32 crore.
A Division Bench of Justices A. S. Gadkari and Kamal Khata passed the direction after noting that the appellant had not complied with the directions in the Single Bench's order dated 13 July 2026. The judges held:
“Appellant is directed to deposit the entire cost of Rs. 82,42,868 + additional cost of Rs. 50,00,000/- totaling to Rs. 1,32,42,868/- in the Registry of this Court within a period of one week from today.”
The Single Bench had, by its 13 July order, imposed costs of Rs. 82,42,868 on trader Harichand Nagpal for violating an injunction protecting the NOVA trademark held by Dr. Ashok M. Bhat.
Nagpal challenged the order before the Division Bench. However, the Bench noted that the “directions issued vide impugned Order dated 13th July 2026, have also not been complied with by the Appellant till today.”
Counsel for Nagpal, on instructions from his son, then offered to deposit an additional Rs. 50 lakh over and above the costs imposed by the Single Bench.
The Bench accepted the statement and directed Nagpal to deposit Rs. 1,32,42,868, comprising the original costs of Rs. 82,42,868 and the additional Rs. 50 lakh, in the Registry within one week.
The matter is listed for 16 September 2026.
