    The Supreme court recently requested the NCLAT to examine whether a court-constituted committee should oversee all projects of Supertech Ltd or whether such monitoring should continue only for the 16 projects already entrusted to NBCC, noting the urgency arising from stalled developments.

    A bench of Chief Justice Surya Kant and Justice Joymalya Bagchi, while referring the issue to the appellate tribunal, said:

    “In this view of the matter, we request the learned NCLAT to consider the issue as to whether or not a Court constituted Committee should be appointed for managing the affairs of all the projects of Supertech Ltd. and/or whether such arrangement should be allowed to continue only in respect of the 16 projects, which has been entrusted to NBCC.”

    The top court's directions come in light of its earlier judgment dated February 5, 2026, where it upheld the NCLAT's decision to entrust 16 stalled projects of Supertech to NBCC under a court-monitored framework, aimed at safeguarding homebuyers awaiting possession for over two decades.

    It had also directed that no court or tribunal should pass interim orders halting construction by NBCC, observing: “To ensure there is no impediment to the completion of the housing projects, it is directed that no Tribunal or Court, including the High Court, shall pass any interim order or directions stopping any project from being commenced by NBCC.”

    Subsequently on April 10, 2026, the court flagged the need for a broader court-monitored framework after the suspension of the Interim Resolution Professional indicating that all projects beyond the 16 assigned to NBCC may require unified supervision.

    Background

    The dispute originates from insolvency proceedings initiated in 2022 against Supertech by Union Bank of India, owing to non-completion of multiple housing projects launched in Noida, Greater Noida, Gurugram and other places between 2010-2012.

    The NCLAT by judgment dated December 12, 2024, directed that 16 stalled projects be completed through NBCC under a court-monitored framework and ordered constitution of an Apex Court Committee along with project-wise committees to supervise construction, funding and distribution of receivables.

    This arrangement was challenged before the Supreme Court by various stakeholders, including promoters and creditors, who questioned the NCLAT's jurisdiction to entrust projects to a third-party entity like NBCC.

    Taking note of these developments, the Supreme Court has now directed the NCLAT to consider the issue expeditiously and listed the matter for further hearing on May 7.
