Delhi RERA Restrains NBCC From Coercive Action Against Rajeshwari Realty In Saket Project Dispute

With NBCC's appeal pending before the Real Estate Appellate Tribunal (REAT) and no stay in operation, the Delhi Real Estate Regulatory Authority (RERA) on February 11, 2026 restrained National Buildings Construction Corporation Limited from initiating coercive recovery steps against Rajeshwari Realty Pvt. Ltd. over electricity and maintenance dues.
“Keeping in view the order passed by this Authority, and the fact that the appeal is pending before the Hon'ble REAT, we direct the Respondents not to take any coercive action against the Applicant till next date of hearing,” the Bench comprising Chairperson Anand Kumar and Member Devesh Singh ordered.
The direction was issued in execution proceedings initiated by Rajeshwari Realty in connection with an ongoing dispute concerning a commercial project in Saket.
The dispute stems from earlier proceedings before the Authority over the project's regulatory status and compliance requirements. NBCC subsequently moved REAT challenging the Authority's order.
During the hearing, counsel for both sides confirmed that the appeal is pending. No stay has been granted so far. The appeal is listed for hearing on March 9, 2026.
The immediate trigger for the present proceedings was a demand letter dated January 30, 2026 issued by NBCC seeking payment of electricity dues. Rajeshwari Realty informed the Authority that recovery steps were being pursued despite the pendency of the appeal.
Appearing for the applicant, counsel submitted that coercive recovery during the pendency of the appeal would cause prejudice. The applicant sought interim protection against any action relating to electricity or maintenance dues until the appellate forum decides the matter.
Recording the pendency of the appeal, the Authority granted interim protection and restrained NBCC from taking any coercive action against Rajeshwari Realty until the next date of hearing.
The matter has been listed before RERA for further proceedings on March 18, 2026.
