The Bombay High Court on Thursday (November 5) directed the removal of objectionable content concerning television actor Rupali Ganguly from the internet, granting her ad-interim protection in her personality rights suit.
Justice Madhav Jamdar directed social media platforms and other entities responsible for hosting or circulating the objectionable content concerning Ganguly to take it down. The direction, however, does not extend to Huts and Looms Pvt. Ltd.
The company has contended that it used only photographs of Ganguly that the actor herself had shared through her stylist.
Ganguly approached the Court alleging that various online platforms and entities were unauthorisedly exploiting her identity for commercial gain by using her photographs and video clips.
She also alleged that some had created and circulated AI-generated images and videos, including deepfakes, featuring her.
In her plea filed through Advocate Sana Raees Khan, Ganguly submitted that her 25-year-long career in television had established her as a recognised personality and household name.
She referred to her work in popular shows such as Kahaani Ghar Ghar Kii, Sanjeevani, Sarabhai vs Sarabhai and Anupamaa.
She also relied on the recognition she had received over the years, including awards such as the Star Parivaar Awards and Indian Television Academy (ITA) Awards, to highlight her standing in the entertainment industry.
The suit seeks protection against the unauthorised commercial use of her name, image and likeness, including through digitally manipulated content.
