Delhi High Court Appoints Amicus Curiae In Janhvi Kapoor's Personality Rights Suit

Justice Anup Jairam Bhambhani made the appointment “considering the importance of the issues involved" in these matters and fixed a date in September.

The appointment comes amidst concerns of overbroad prayers made in recent personality rights suits, including Kapoors.

In Kapoor's suit, counsel Asav Rajan informed the court that the various URLs cited, which were nearly 6,884, had now been categorised as directed in earlier hearings and sought an early date to consider interim relief.

The court agreed to take this up before the end of September, listing it for September 22.

Advocate Alva was granted liberty to file his note of submissions without needing to serve it on the other parties in the matter.

Janhvi Kapoor's case was first heard in August, when the court declined to pass a blanket injunction against the nearly 6,884 URLs she had cited as infringing her personality rights, remarking that such broad relief could be misused and that "it is going out of hand."

The court instead confined interim protection to three narrow categories: content that is obscene or pornographic, content directly monetising her persona, and content using her name and likeness to sell merchandise, while leaving the larger questions, including the treatment of fan pages and the outer limits of personality rights protection, for fuller argument.

In Oberoi's case, the court had granted the actor an ad interim relief on February 5, temporarily restraining the unauthorised use of his name, image, likeness, and voice, including through AI-generated content.
