On the date the film “DO DEEWANE SEHER MEIN” was slated for release, the Madras High Court granted an ad interim injunction restraining unlawful broadcast of the movie in a suit alleging apprehended infringement of copyright.
Justice Senthilkumar Ramamoorthy passed the order on Friday in two applications filed by Zee Entertainment Enterprises Limited, the producers of the film, which has arrayed 33 defendants, including Bharath Sanchar Nigam Limited and others.
The court recorded that the suit seeks remedies in respect of the apprehended infringement of the plaintiff's copyright in the cinematographic film titled “DO DEEWANE SEHER MEIN”.
As evidence of ownership, Zee filed the CBFC certificate describing it as the producer. The Court noted that the promotional material revealed that the movie was slated for release that day.
Granting relief, Justice Ramamoorthy observed, “In matters of this nature, it is likely that irreversible injury will occur unless unlawful broadcast is prevented.”
At the same time, the Court expressed caution over the breadth of the relief sought, stating, “In view of the expansive nature of the relief claimed, it is possible that the legitimate business interest of one or more respondents may be affected.”
The court therefore made the injunction conditional, holding that “it is necessary that the plaintiff shall indemnify in respect thereof.”
Subject to this condition, ad interim injunctions as prayed for were granted until March 11, 2026. Notice was issued to the respondents, private notice was also permitted, and the applicant was directed to comply with Order XXXIX Rule 3 of the CPC. The matter is listed on March 11, 2026.
In a separate but similarly worded order passed the same day, Justice Ramamoorthy granted identical ad interim relief in respect of the film "ASSI," a Taapsee Pannu-starrer, in a suit filed by Super Cassettes Industries Pvt. Ltd. alleging apprehended infringement of its copyright.
The Court recorded that the promotional material revealed that the movie was slated for release that day and, subject to the same indemnification condition, granted an ad interim injunction until March 11, 2026.
