Delhi Court Awards ₹20 Lakh Damages To Siemens In NX Software Piracy Case

A Commercial Court at Saket, New Delhi, has decreed a copyright infringement suit in favour of Siemens Industry Software Inc.and its Indian subsidiary, restraining Maharashtra-based mould maker Om Sai Moulds and Plastics and its promoters from using unlicensed copies of its NX (Unigraphics) software.
In a judgment dated February 19, 2026, District Judge Anuradha Shukla granted a permanent injunction and awarded 20 lakh in damages.
Siemens told the court that the defendants held only two node-locked licences but were using the software on 8–10 systems. It relied on unauthorised user data showing thousands of usage events across multiple machine IDs.
The defendants, on the other hand argued that they had purchased perpetual licences and were entitled to continue using them. They also claimed the suit was barred by waiver, acquiescence, delay and latches.
Rejecting the defence, the Court called the reliance on perpetual licences a “misconception.” It recorded that a node-locked licence means the software “can be installed on a particular designated computer only.” Even if perpetual, “it works only on the hardware on which it is installed.” It does not permit use on “N number of systems.”
On delay, the Court held that failure to follow up on maintenance renewal does not mean the plaintiffs would have “discovered that the defendants have started using the software on multiple systems unauthorizedly.”
The Court took note of the Local Commissioner's report. Employees were seen “removing CPU, computer systems, etc. from the office premises” during the inspection. This conduct, the Court held, “points out towards a probability that infringing material was there in their premises.”
Applying the civil standard of “preponderance of probabilities,” the Court held that infringement stood proved. It also noted that the defendants failed to produce any “logs of usage of NX software” to rebut the allegations.
The suit was decreed. The defendants have been permanently restrained from reproducing, storing, installing, or using pirated or unlicensed NX software, except for the two licensed copies they own. The Court also awarded 20 lakh in damages and directed that actual costs of the plaint be paid to the plaintiffs.
