Delhi Commercial Court Orders Blocking Of Websites Selling Pirated TrendyTech Course

A commercial court in Saket, New Delhi, has granted an ex parte interim injunction restraining the unauthorised sale and distribution of pirated copies of TrendyTech Insights LLP's copyrighted "GDL TrendyTech Ultimate Big Data Masters Program" course.

It also directed the Department of Telecommunications (DoT) and the Ministry of Electronics and Information Technology (MeitY), along with internet service providers and other intermediaries, to block access to the infringing websites, while directing Meta Platforms to preserve subscriber and registration records, payment details, IP logs and other identifying information relating to the infringing platforms.

District Judge Sandeep Yadav ruled that TrendyTech had "succeeded in making out a prima facie case in its favour," adding that the "balance of convenience also lies in favour of plaintiff and against the defendants."

The court further observed that the company "will suffer irreparable loss and injury if interim injunction is not granted at this stage."

TrendyTech, a Bengaluru-based ed-tech company, alleged that websites linked to Courseheistshop, along with a Facebook page and an Instagram account, were selling its proprietary "GDL TrendyTech Ultimate Big Data Masters Program" for ₹199 without authorisation while prominently using its "TRENDYTECH" brand.

After examining the plaint, supporting documents and screenshots of the allegedly infringing platforms, the court observed that "it is clear from the averments of plaint and documents placed therewith the plaintiff is the author of artwork involved in the course being offered by plaintiff under the title 'GDL TrendyTech Ultimate Big Data Masters Program'."

Pending the next hearing, the court restrained the unidentified operator behind the infringing platforms from reproducing, hosting, distributing or selling TrendyTech's copyrighted course material without authorisation.

It also directed the operators of the identified websites and social media accounts to remove and disable access to the infringing content, ordered Meta Platforms, DoT and MeitY to preserve subscriber and registration records, payment details, IP logs and other identifying information relating to the operators of the infringing platforms, and directed DoT, MeitY, internet service providers and other intermediaries to block access to the infringing websites, including mirror and redirect sites.
