Delhi High Court Restrains 14 More Websites From Using 'BETWAY' Trademark

The Delhi High Court has recently restrained 14 more websites from using the trademark "BETWAY" or any deceptively similar mark in a trademark infringement suit filed by Merryvale Limited, the proprietor of the registered BETWAY trademark.

BETWAY is an online sports betting and gaming brand owned by Merryvale Limited.

The latest order extends interim protection granted earlier against similar allegedly infringing websites.

Justice Jyoti Singh held that Merryvale had established a prima facie case against the newly impleaded websites. The court also found that the balance of convenience lay in the company's favour and that refusing interim relief would cause irreparable harm.

The court observed, "Plaintiff has made detailed averments in the application to show the infringing activities of Defendants No. 41 to 54, which is prima facie leading to infringement of Plaintiff's registered mark BETWAY as also resulting in misrepresentation to the general public."

With the latest order, the number of websites restrained in the suit has risen to 45. The court had earlier granted similar injunctions against 31 rogue websites through orders passed between August 2024 and September 2025.

Merryvale moved the application after 14 additional websites were brought on record in the suit. It sought an interim injunction against the newly added websites and directions to the concerned Domain Name Registrars.

According to the company, the newly added websites were operating under the BETWAY mark or deceptively similar trade names and domain names while offering betting services on sports and games.

Merryvale alleged that the websites used graphics and layouts similar to those of the genuine BETWAY platform and sought personal details from users, creating the impression that they were associated with the company. Counsel for Merryvale also submitted that the court had already restrained several similar rogue websites in the same proceedings and sought extension of the earlier injunctions to the newly identified domains.

Allowing the application, the court restrained the newly impleaded websites and all persons acting on their behalf from using the BETWAY mark or any deceptively similar mark as a trademark, trade name, domain name, web address, email address or social media handle, or in any other manner amounting to infringement or passing off.

The court further held, "Balance of convenience lies in favour of the Plaintiff and if the interim injunction, as sought, is not granted, irreparable harm and injury shall be caused to the Plaintiff."

The court directed the concerned Domain Name Registrars to lock and suspend the 14 domain names identified in the order within 36 hours of receiving it.

They have also been directed to furnish the names, phone numbers, addresses and payment details of the domain registrants to Merryvale within six weeks.

The Ministry of Electronics and Information Technology and the Department of Telecommunications have also been directed to issue notifications to all telecom and internet service providers within 36 hours of receiving the order.
