Delhi High Court Restrains Unknown Entities From Impersonating Aditya Birla Sun Life AMC, Officials

The Delhi High Court has recently granted an ad-interim injunction restraining unknown entities from impersonating Aditya Birla Sun Life AMC Limited and its senior officials to run fraudulent investment schemes until the next date of hearing.

The court also directed WhatsApp to remove the impugned groups and suspend the identified profiles within 36 hours.

Justice Jyoti Singh passed the order on a suit filed by Aditya Birla Sun Life AMC Limited, an asset management company, against unknown entities as well as the Ministry of Electronics and Information Technology (MeitY), the Department of Telecommunications (DoT), Google, Meta and WhatsApp.

According to the company, it first discovered around September 2025 that unknown persons were impersonating its Managing Director, Chief Executive Officer and other senior officials.

They allegedly invited members of the public to join fraudulent investment groups by offering market insights, investment advice and assurances of attractive financial returns. The company also alleged that the impersonators circulated fake employment opportunities and other deceptive financial offers.

One individual identifying herself as "Diya Mehra" was allegedly claiming to be associated with the company's senior management. The company said she used that false identity to induce people to participate in fraudulent investment schemes, purported job opportunities and other deceptive financial arrangements.

The company further alleged that the impersonators had floated fraudulent mobile applications, "ABSLNHW" and "ABSLPRIV". According to the suit, the applications imitated its ABSLAMC branding and falsely projected themselves as the company's official investment platforms.

The applications were later taken down with the assistance of the company's cyber security team and third-party IT firm IZOOlogic. Even so, the company expressed apprehension that similar applications could reappear.

The company also submitted that the impersonators operated multiple bank accounts across several banks to receive money from unsuspecting victims under the guise of legitimate investment transactions. It cited several instances of people transferring lakhs of rupees.

The suit further alleged that forged application approval forms bearing false and fabricated stamps were used to induce investments. Victims had also lodged FIRs alleging cyber fraud. The company maintained that it had no association whatsoever with the impugned applications or the WhatsApp groups.

After considering the material placed on record, the court held that the company had made out a prima facie case for granting the ad-interim injunction.

"Balance of convenience lies in favour of Plaintiff and it is likely to suffer irreparable harm in case the interim injunction, as prayed for, is not granted," the court observed.

The court restrained the unknown entities from using or exploiting the company's brand, goodwill, names and logos, including "Aditya Birla Sun Life AMC Limited" and "Aditya Birla Capital".

It also barred them from misrepresenting themselves as the company, its Managing Director, Chief Executive Officer or employees on any platform.

WhatsApp was directed to remove the impugned groups and suspend the profiles identified in Annexure A to the order within 36 hours of receiving the order.

The court also directed MeitY and the Department of Telecommunications to notify internet service providers to block access to the infringing URLs in the suit. The company did not press for blocking the remaining URLs.

The matter will next be heard on December 3, 2026.
