Telangana School Agrees To Drop 'Vasant Valley' Name In Trademark Suit Filed By Delhi School

The Delhi High Court has decreed a trademark suit filed by Education Today, which runs Vasant Valley School in New Delhi. The decree came after a Telangana-based school agreed under a settlement to change its name by June 30, 2026, remove the registered mark "Vasant Valley" from its name, and stop using the mark or any deceptively similar mark.

Justice Tushar Rao Gedela disposed of the suit in terms of a settlement agreement dated May 12, 2026. Under the agreement, Vasant Valley Concept School, Karimnagar, undertook to apply to the Telangana Education Department, the Telangana State Board of Secondary Education and other competent authorities within 30 days for changes to its registration and affiliation certificates.

The defendant agreed to cease all use of the mark "Vasant Valley" and any deceptively similar mark on banners, hoardings, stationery, uniforms, catalogues, brochures, publicity material, and all other materials stored in physical or digital form. The exercise is to be completed on or before June 30, 2026.

Under the settlement, the school undertook that its website and YouTube page had already been permanently taken down. It also agreed to take down its Instagram page and coordinate the removal of its JustDial listing.

The school further undertook to permanently refrain from using any domain name incorporating the mark "Vasant Valley" or any deceptively similar mark. It also agreed not to apply for, seek registration of, or register any trademark, trade name, logo, device, domain name or other commercial identifier identical or deceptively similar to "Vasant Valley" in India or abroad.

The parties jointly stated before the court that the defendant school was neither associated, affiliated, connected with nor endorsed by Education Today or Vasant Valley School, New Delhi.

In return, the plaintiff agreed not to seek damages or rendition of accounts of profits from the defendant.

The court directed the defendant to file a compliance affidavit on or before July 10, 2026. It then decreed the suit in terms of the settlement agreement.

For Education Today: Senior Advocates Rajiv Nayar and Mr. Nakul Dewan wtih Advocates Ketan Gaur, Ankit Pal, Utsav Saxena, Maujina Dasgupta and Satyendra S.

For Defendants: Lokesh Kumar Sharma, Advocate for D-1; Varun Pathak, Akhil Shandilya and Vishwajeet Deshmukh, Advocates for D-5.
