The Delhi High Court on 10 August granted an ex-parte ad-interim injunction restraining FMCG company Ga Se Gaanv Essence LLP from using “RANI SAHIBA” or any deceptively similar mark for rice products, and from passing off its goods as those of Rakesh Jain.

A Bench comprising Justice Anup Jairam Bhambhani also directed the takedown of an infringing Amazon listing and other online references bearing the mark. He observed:

“This court is of the view that the plaintiff has succeeded in making-out a prima-facie case in its favour; that the balance of convenience also lies in favour of the plaintiff and against the defendants; and it would appear that irreparable loss and injury would be caused to the plaintiff if the interim injunction as prayed-for is not granted.”

Jain approached the Court seeking to restrain Ga Se Gaanv Essence LLP from manufacturing, selling or advertising rice under the mark “RANI SAHIBA”, claiming that it was deceptively similar to his registered word mark.

He stated that “RANI SAHIBA” had been registered since 1 April 2012. He further submitted that the Examiner of Trade Marks, by an order dated 26 November 2025, had confirmed continuous use of the mark since 2012 “with no cited mark conflict and no likelihood of confusion in Class 30 goods.

Further, Jain alleged that Ga Se Gaanv, while selling rice under its own house brand, had dishonestly appropriated “RANI SAHIBA” for its product. He argued that the phrase was neither an attribute, characteristic nor feature of basmati rice and that Ga Se Gaanv had no legitimate reason to use it.

Accordingly, the Court restrained Ga Se Gaanv from dealing in rice under the “RANI SAHIBA” mark or any deceptively similar mark, or from passing off its goods as those of Jain. It also directed the takedown of the infringing Amazon listing and other online listings, WhatsApp catalogues and references bearing the mark until the next date of hearing.
