Delhi High Court Restrains Ajmer Spa From Using "ANANTARA" For Similarity With MHG IP Holding's Mark

The Delhi High Court has temporarily restrained Anantara Spa and Massage, an Ajmer-based spa, from using the mark “ANANTARA” or any deceptively similar variant in a trademark infringement suit filed by MHG IP Holding Singapore Pte Ltd which is part of the Minor International Public Company Limited group, widely known as the 'Minor Hotel Group'.

Justice Jyoti Singh passed the ex-parte ad interim injunction, noting that MHG IP held valid and subsisting registrations for the ANANTARA mark since 2001, and that the defendant's marks “subsume the mark ANANTARA in entirety.”

She held that the defendant “does not have a plausible justification for adopting the impugned marks incorporating ANANTARA,” and that the intent appeared to be to “sail close to the Plaintiffs and encash on the formidable reputation and goodwill for unlawful financial gains.”

During a routine review in May 2026, the plaintiffs discovered that the defendant was operating as “Anantara Spa and Massage” in Ajmer and had adopted the brand name and logos incorporating ANANTARA.

The plaintiffs stated that the defendant promoted services including “Body to Body Massage” and “Thai Massage” through its website. They submitted that associating such services with the ANANTARA mark was “gravely prejudicial” to its reputation and amounted to “trademark dilution by tarnishment.”

The Court found that the defendant had no plausible justification for adopting the impugned marks and that the plaintiffs had established a prima facie case of infringement and passing off.

Accordingly, the High Court restrained Anantara Spa and Massage from using the marks ANANTARA and ANANTARA SPA, or any deceptively similar mark, for spa, massage or wellness services. It also directed the defendant to remove all references to the impugned marks from its website, social media pages and online listings within three weeks.
