Delhi High Court Grants Temporary Injunction To Google's Waymo, Bars Use Of 'P-WAYMO' Mark

The Delhi High Court recently granted an ad interim injunction in favour of Waymo LLC, a subsidiary of Google's parent Alphabet Inc., restraining an Indian entity from using the mark “P-WAYMO” or any deceptively similar variant in a trademark dispute.

A single-judge Bench of Justice Jyoti Singh said, “Having heard learned counsel for the Plaintiff and upon perusal of the documents, I am of the view that Plaintiff has made out a prima facie case for grant of ad interim injunction against the Defendants. Balance of convenience lies in favour of the Plaintiff and it is likely to suffer irreparable harm in case the interim injunction, as prayed for, is not granted”

Waymo traces its origins to Google's self-driving car project launched in 2009 and holds statutory rights over its “WAYMO” trademarks across multiple jurisdictions, including registrations dating back to 2016.

According to the company, the defendant company was operating the website www.pwaymo.com to sell electric scooters and three-wheelers while prominently using the mark “P-WAYMO.” It alleged that after receiving a cease-and-desist notice, the defendant modified its logo to emphasise the word “WAYMO,” reflecting an attempt to appropriate its trademark and goodwill.

Waymo further told the court that its investigation revealed that the defendant had shifted operations to Bhubaneswar, Odisha, and was offering both electric and fuel-based vehicles for delivery in Delhi.

It argued that “WAYMO” is an invented and inherently distinctive mark and that use of “P-WAYMO” in relation to allied transportation services was likely to mislead consumers into believing an association with the company.

Accepting the plea at this stage, the court restrained the defendants, their directors and representatives from using the impugned mark or any deceptively similar mark as a trademark, trade name, domain name, social media handle, or email identifier.

The court also directed P-Waymo Electric Vehicles Private Limited to take down infringing listings and URLs hosted on platforms including Wix, Just Dial, Facebook and Instagram.

The matter is now listed for further hearing on August 19, 2026
