Delhi Court Grants Relaxo Permanent Injunction After Manufacturer Undertakes Not To Use Its Trademarks

A Delhi commercial court on May 15, 2026, passed a decree of permanent injunction in favour of Relaxo Footwears Limited against a Nangloi-based footwear manufacturer after he undertook before the court that he had shut down his manufacturing unit and would not use Relaxo's trademarks, including 'Sparx', 'Flite', 'Bahamas' and 'Kids Fun', or any identical, confusingly similar or deceptively similar trademarks in future.

District Judge Preeti Agrawal Gupta observed that the defendant's statement was "not only categorical but is conscious and deliberate compliance, clearly showing an unequivocal intention of the defendant namely Sh. Praveen Yadav, to be bound by his statement made before this Court 'on oath'"

The suit was originally filed in December 2025 as a John Doe action after Relaxo alleged that a unit at Nangloi, Mundka was manufacturing, stocking and selling counterfeit footwear bearing its trademarks.

A local commissioner was appointed, and the premises were searched. During execution of the commission, the defendant, Praveen Yadav, was identified and later impleaded in the case.

After being served, Yadav appeared in person and told the court that he had no knowledge of Relaxo's trademark rights in respect of the articles seized by the local commissioner and had shut down the manufacturing unit entirely.

He also undertook not to use Relaxo's trademarks or any identical, confusingly similar or deceptively similar trademarks in future.

On this basis, Relaxo pressed only for a decree of permanent injunction and did not pursue its other claims.

The court accordingly decreed the suit and permanently restrained Yadav and all persons acting on his behalf from manufacturing, selling, offering, or dealing in products bearing Relaxo's trademarks or any identical or deceptively similar marks.
