Supreme Court Declines Bail To Punjab Minister Sanjeev Arora On Medical Grounds In PMLA Case

The Supreme Court on Tuesday dismissed the medical bail plea of Aam Aadmi Party (AAP) MLA and Punjab Minister Sanjeev Arora in a money laundering case. It noted that his regular bail application is already pending before the Punjab and Haryana High Court.

A Division Bench of Justices Satish Chandra Sharma and Nongmeikapam Kotiswar Singh also recorded the Centre's undertaking that Arora would receive the best possible medical treatment. This would include an angiography, if required.

"However, as the bail petition of the petitioner herein is already listed on 05.08.2026 before the High Court of Punjab and Haryana at Chandigarh, and as learned Additional Solicitor General on instructions has given a categoric undertaking before this Court to ensure best possible treatment to the petitioner even for an Angiography in case need so arises in future, this Court is of the opinion that the present special leave petition deserves to be dismissed and is accordingly dismissed."

The court also clarified that the Jail Authorities shall provide all necessary treatment to Arora in case of any medical emergency.

Pursuant to an earlier order of the Supreme Court dated July 20, Arora was examined by a six-member AIIMS Medical Board. The Board found him clinically stable but recommended continued medical management and an angiography for further evaluation.

The case stems from the ED's money laundering investigation into Hampton Sky Realty Ltd where Sanjeev Arora was the promoter and former Chairman and Managing Director. The agency alleges that HSRL fraudulently claimed export proceeds of about ₹102.5 crore through bogus mobile phone exports to UAE based entities using shell suppliers and forged invoices.

Seeking regular bail before the Special PMLA Court at Gurugram, Arora contended that the exports were genuine, had been cleared by Customs, the alleged proceeds of crime had not been established, and that the ED had arrested him without sufficient incriminating material. On June 15, 2026, the Special Court rejected Arora's bail plea, holding that the material collected by the ED disclosed a prima facie case of money laundering and that the Court could not record satisfaction under Section 45 of the PMLA that he was not guilty of the offence.

Before the Supreme Court, senior advocate Mukul Rohatgi appearing for Arora, submitted that his regular bail application had been rejected by the Special PMLA Court on June 15, 2026, following which he approached the Punjab & Haryana High Court. He contended that despite seeking interim medical bail, the matter was not being heard, prompting him to move the Supreme Court.

The ED assured the Court that the petitioner would receive the best possible medical care, including angiography if required.

Holding that Arora's regular bail plea was already listed before the Punjab & Haryana High Court and in view of the ED's assurance regarding his medical treatment, the Court declined to entertain the medical bail plea and dismissed the petition.
