Karnataka High Court Stays CCPA Direction Asking Flipkart To Pay ₹10 Lakh Over Sale Of Walkie-Talkies

The Karnataka High Court on Monday stayed the direction to pay a Rs 10 lakh penalty imposed on Flipkart Internet Pvt Ltd by the Central Consumer Protection Authority (CCPA) over the sale of walkie-talkies on its platform until the next hearing. 

Justice B. M. Shyam Prasad passed the interim order while hearing a writ petition filed by Flipkart challenging the CCPA's assumption of jurisdiction and the directions issued against it.

In consideration thereof, the interim order is granted staying the direction of payment of penalty of Rs.10,00,000/- until the next date of hearing, and consequentially, the further direction to the petitioner for periodical self audit is also stayed for the present.,” the court said.

The dispute arose from a suo motu action initiated by the CCPA in January 2026 after taking cognisance of the sale of walkie-talkies on Flipkart's website and mobile application. It was alleged that the products were being sold without mandatory disclosures and regulatory approvals under the Consumer Protection Act and the Consumer Protection (E-Commerce) Rules, 2020.

Following an investigation by its Director General, the authority held that Flipkart had failed to exercise due diligence and imposed a penalty of Rs. 10 lakhs, along with directions for periodic self-audits.

Before the high court, Flipkart submitted that it had complied with the direction to delist the concerned products from its platform. However, it questioned the CCPA's jurisdiction. Flipkart argued that it operates purely as an intermediary and marketplace facilitator and that responsibility for regulatory compliance rests with independent sellers listed on its platform rather than with the intermediary itself.

The court has re-listed the matter for further hearing on February 11.
