The Delhi High Court has set aside a November 27, 2025, order directing restoration of properties attached by the Enforcement Directorate in the Greenopolis housing project case. It has appointed a three-member Monitoring Committee to verify genuine homebuyer claims and streamline the restitution process.

Justice Anup Jairam Bhambhani appointed former Chief Justice of the Supreme Court of India Justice Sanjiv Khanna as the committee's chairperson. The committee will also comprise former Principal District Judge, New Delhi District, H. S. Sharma and former Additional District & Sessions Judge, Delhi, Ajay Kumar Kuhar.

The court observed that the committee was necessary because of the “manifold complexities arising from the sheer numbers of claimants and competing claims over the attached assets.”

The Greenopolis project is spread across about 47.218 acres in the villages of Hayatpur and Badha in Gurugram's Sector 89. A development agreement dated November 2, 2011 involved Three C Shelters Pvt Ltd, Orris Infrastructure Pvt Ltd, Three C Universal Developers Pvt Ltd and certain landowners.

According to Haryana Real Estate Regulatory Authority records cited in the judgment, the project had 1,862 units, of which 1,650 had been allotted as of January 23, 2019. Three C Shelters collected ₹776.60 crore from homebuyers, while Orris collected about ₹383.06 crore.

The dispute involves two sets of proceedings. Three C Shelters is undergoing insolvency proceedings under the Insolvency and Bankruptcy Code, while the Enforcement Directorate's proceedings under the Prevention of Money Laundering Act arose from an Economic Offences Wing case against Three C Shelters, Orris and their former promoters.

The court held that the PMLA and insolvency proceedings operate on distinct pools of assets. It noted that properties attached by the Enforcement Directorate which do not belong to the corporate debtor do not fall within the remit of the insolvency resolution professional.

The court also found the November 27, 2025 order of the PMLA court unsustainable. The order had directed restoration of properties attached under a provisional attachment order and permitted their disposal for restitution.

The High Court observed that Rule 3A of the PML Rules governs restoration of attached properties during trial, but can be invoked only after charges have been framed.

“Rule 3A of the PML Rules, which governs restoration of attached properties by the PMLA Court, comes into play only after framing of charges,” the court held.

The court also ruled that the insolvency resolution professional had no statutory role in the PMLA proceedings. The November 27 order was accordingly set aside, while interim orders passed on January 3 and January 21, 2026 were recalled and vacated.

The court clarified that it would not precipitate liquidation of any attached properties at this stage.

The Monitoring Committee will verify genuine homebuyers, irrespective of whether they paid Three C Shelters or Orris. It will also maintain a list of attached assets, verify payments, and scrutinise supporting documents.

Claimants must file affidavits stating that they have no relationship or nexus with the promoters of Three C Shelters, Orris or their affiliate, associate, or group entities. They must also disclose whether they are property dealers, brokers or otherwise engaged in the real estate business.

The committee is expected to complete its role within eight months of its first meeting and submit reports every three months. The Enforcement Directorate has been directed to transfer money from specified bank accounts to the “Account-Greenopolis Monitoring Committee” within one week.
