Delhi High Court To Pass Order Protecting Crocs' Designs, Trademarks and Patent Over Jibbitz Charms
The Delhi High Court on Monday indicated that it will pass ad-interim relief orders in an infringement suit filed by Crocs Inc. against Summersalt Lifestyle Private Limited.
Crocs Inc. alleged that the defendant has copied its three registered designs and two trademarks and infringed one patent, while also engaging in passing off.
During the hearing before Justice Tushar Rao Gedela, Crocs submitted that the defendant has replicated a range of its footwear products and placed on record side-by-side comparisons to demonstrate similarity.
At the centre of the dispute is Crocs' patented "Jibbitz Charms," which allows decorative attachments to be plugged into holes on the upper portion of its footwear.
Explaining the feature, counsel submitted that “Jibbitz are very interesting pieces which get plugged into those holes. So for novelty purposes children love this variety.”
Crocs argued that the defendant's products use a similar hole and plug mechanism, thereby infringing its patent.
In addition, Crocs alleged that several of its registered designs, including Echo, Echo Slide, and Toddler Classic, have been copied. "Not one product but a whole range of my products. They just copied them,” the counsel submitted.
Crocs also relied on its registered shape trademarks, submitting that the shape of its footwear is protected and comparable to well-known shape marks such as the Zippo lighter, Nutella jar, and Ferrero Rocher chocolate.
Further, Crocs alleged infringement of its word mark “Crocs lite,” submitting that the defendant used a deceptively similar mark in relation to its products.
The Court, after hearing the submissions, stated that it will pass orders.
The matter is listed before the Joint Registrar on July 9, 2026 and before the Court on September 29, 2026.
