Delhi High Court Grants Temporary Injunction Against Unauthorised Use Of Bentley Software
The Delhi High Court has passed an ad interim injunction in favour of Bentley Systems, a US-based infrastructure software provider, restraining a structural design services firm and its directors from allegedly infringing copyright in its engineering software.
Justice A. J. Bhambhani passed the order on a suit filed by Bentley Systems Inc and its Indian subsidiary.
The software programmes at issue in the case are RAM Concept, iTwin Analytical Synchronizer, iTwin Services Add-in, and STADD.
The suit is directed against a firm engaged in engineering and structural design services, along with its three directors.
Bentley Systems told the court that it provides infrastructure software solutions to engineers, architects, geospatial professionals and infrastructure operators worldwide.
It was further submitted that its Indian subsidiary carries out the company's business activities and anti-piracy efforts in India.
Bentley's counsel submitted that the company's registered copyright was being infringed through unauthorised, unlicensed use of its software by one of the defendants, and that this had come to light through "phone-home" technology, a mechanism built into the software that reports back usage data, which had flagged the unauthorised use.
The court held that, on a preliminary appreciation, Bentley had made out a prima facie case, with the balance of convenience in its favour and a likelihood of irreparable harm if interim relief was not granted.
It granted an ex parte ad interim injunction against the defendants till the next hearing.
The matter will next be listed before the Joint Registrar on December 3 for completion of pleadings.
