Delhi High Court Asks VAT Officer To Decide Voltas' ₹1.79 Crore Refund Claim Within Two Weeks

The Delhi High Court has recently disposed of a writ petition filed by Voltas Limited seeking a VAT refund of ₹1.79 crore pertaining to the first quarter of the financial year 2017-18, after the Delhi government assured the Court that the company's representation would be decided within two weeks.

A division bench of Justices Anil Kshetrapal and Shail Jain was hearing Voltas' plea seeking a direction to the Commissioner of Trade and Taxes to refund ₹1,79,07,807.

During the hearing, counsel appearing for the respondents submitted that the petitioner had approached the High Court directly without first filing a representation before the concerned department.

It was submitted that if Voltas filed an appropriate representation before the concerned VAT Officer, the same would be processed and appropriate orders passed in accordance with law within two weeks of its receipt.

Taking note of the statement, the Court observed that no further orders were required in the writ petition.

Accordingly, it disposed of the petition, granting liberty to Voltas to submit an appropriate representation before the concerned VAT Officer.

The court further directed that, if such a representation is filed, it shall be considered and decided in accordance with law within two weeks from the date of its receipt.
